Terms of Service for the Google Chrome Extension „AI Security Assistant“

Section 1 Scope of Application and Subject of Contract

These Terms of Service govern the use of the browser extension „AI Security Assistant LIVE“ (hereinafter „Extension“) for the Google Chrome browser by end consumers (hereinafter „User“). The subject of the contract is the provision of the Extension for execution within the User's browser.

• No Replacement for Emergency Services: This Extension is not an emergency calling service. In acute life-threatening emergencies, always dial 000 (AU) or your local emergency hotline immediately! The Extension does not establish connections to police, fire brigade, or rescue dispatch centers and does not alert first responders.
• AI-Powered Assistance System: The Extension serves as an AI-powered assistance tool to non-bindingly support the User in assessing everyday as well as digital hazard situations on the Internet. For this purpose, the AI punctually analyzes texts, links, web pages, and temporary screenshots submitted by the User.
• Objective of the Extension: The Extension aims to highlight potential indicators of digital threats (e.g., fake shops, phishing, crypto fraud, fraudulent offers) through automated heuristics (Live Sentry) and AI-generated evaluations and provide general behavioral advice.
• Non-Binding Nature: The Extension provides exclusively non-binding information and plausibility assessments. A specific outcome, in particular the actual detection or prevention of every conceivable hazard, the prevention of criminal offenses, or the guarantee of absolute security, is expressly not owed.
• No Legal Advice: The automated threat evaluations, analyses, and recommended action steps provided by the Extension serve exclusively as technical IT security prevention and do not constitute legal advice or legal representation.

Section 2 Important Notice on Artificial Intelligence (AI) and Personal Responsibility

• No Guarantee of Flawlessness: The Extension uses advanced Artificial Intelligence (Google Gemini Enterprise) for analysis. The User is expressly advised that AI systems can make mistakes, misinterpret facts, or exhibit so-called „hallucinations“ (inventing facts).
• Absence of Global Context: The AI evaluates a situation solely based on the fragments submitted by the User (e.g., text snippets, webpage metadata, screenshots). The AI cannot know or capture the broader picture, individual history, or circumstances outside the submitted data.
• Non-Binding Recommendations: All risk classifications (risk traffic light), warnings, and action plans generated by the Extension are purely informative and represent non-binding recommendations. They do not replace common sense, human expertise, or legal or police counsel.
• Ultimate Decision Lies with the User: The Extension serves merely as an assistance tool. The final assessment of any situation as well as the decision to make online purchases, transfer funds, click links, or enter personal data remains at all times the sole responsibility of the User.

Section 3 Guidelines for Contacting Emergency Services and Law Enforcement Authorities

• System-Generated Recommendations and Personal Responsibility: Insofar as the Extension generates automated recommendations based on user-submitted facts, these align with standard police and rescue service procedures. These recommendations may include advice to contact emergency dispatchers (911/999/112). It is expressly clarified that the Extension cannot verify the actual objective hazard on site. The duty to independently verify the necessity of an emergency call remains fully with the User.
• Permissible Use of Emergency Numbers: Emergency numbers must only be dialed during acute emergencies, present threats to life, physical integrity, or substantial property, ongoing crimes, or acute psychological crises through perpetrator contact.
• Impermissible Use of Emergency Numbers: In cases where the damaging event occurred in the past and no immediate threat persists (e.g., already completed online fraud, fake shops, or property damage), dialing emergency hotlines is impermissible. The User must use regular police stations or official cybercrime online reporting portals.
• Misuse of Emergency Services: Intentional and malicious misuse of emergency hotlines constitutes a criminal offense under applicable law.

Section 4 Grant of Rights

• The User receives a simple, non-exclusive, non-transferable, and non-sublicensable right to run the Extension for private purposes within the browser.
• Any reproduction, modification, decompilation, disassembly, or reverse engineering of the Extension is prohibited, except where permitted by mandatory statutory provisions.

Section 5 Obligations of the User

• The User undertakes to use the Extension exclusively in accordance with these Terms and applicable laws.
• Any abusive use is prohibited. The User is personally liable for all content submitted for inspection.
• It is prohibited to overburden the interfaces of the Extension through automated scripts or bots.
• To ensure system stability and protect against abuse, a fair-use limit of up to 2,500 checks daily applies to the Pro subscription.

Section 6 Tiers (FREE & PRO), 24h Trial, Payment Processing & Cancellation

• Free Basic Access (FREE):
  • Following installation, the User has permanent, free access to the FREE tier, providing up to 3 free security checks per day (URL scans or text analyses) and up to 10 local archive storage slots on the device.
• 1-Day Free PRO Trial (24 Hours):
  • The User is provided with a 24-hour full-access free trial of the PRO tier (0.00 €).
  • Without Payment Details: If no payment details are entered via Stripe, the free trial ends automatically after 24 hours without incurring any costs, and the User remains in the free FREE tier.
  • With Payment Details via Stripe: If the User initiates the 24-hour trial via Stripe by entering payment details, the trial will automatically convert into the paid PRO subscription (3.45 € / month) upon expiration of the 24 hours, unless cancelled prior to the end of the trial.
• PRO (Paid Subscription):
  • The PRO subscription costs 3.45 € / month (final price), unlocking full protection (including 1-click screen scan, real-time website guardian, a large local security archive with up to 500 storage slots, and a fair-use quota of up to 2,500 daily checks for personal use).
  • Pursuant to Section 19 UStG (German Small Business Act), value-added tax is not charged or displayed separately.
• Payment Processing & Freedom of Cancellation:
  • Payments are processed by Stripe Payments Europe, Limited (PCI-DSS Level 1).
  • The PRO subscription can be cancelled at any time on a monthly basis with a single click (including during the 24-hour trial directly in the Stripe Customer Portal). Following cancellation, PRO access remains active until the end of the paid billing month, after which access seamlessly returns to the free FREE tier without additional costs.
• Statutory Right of Withdrawal (Section 355 BGB):
  • Consumers are entitled to a 14-day statutory right of withdrawal. Details are set out in our payment and cancellation terms.

Section 7 Limitation of Liability

• We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the mandatory provisions of the Product Liability Act.
• In cases of slight negligence, liability is limited to foreseeable, contract-typical damages for essential contractual obligations (cardinal obligations).
• Otherwise, liability is excluded. In particular, we do not accept liability for financial or personal damages (e.g., monetary loss from fraud, identity theft, or bad purchases) resulting from reliance on AI assessments.
• We do not guarantee uninterrupted availability of the Extension due to dependence on third-party services (Google Cloud, Gemini API, Stripe).

Section 8 Warranty for Digital Products

Statutory provisions for digital products apply (Sections 327 et seq. BGB). We provide updates to maintain functionality and IT security.

Section 9 Privacy & Data Protection

Personal data processing complies strictly with the General Data Protection Regulation (GDPR). Submitted texts and screenshots are processed transiently, never stored permanently, and under no circumstances used to train AI models. See our Privacy Policy.

Section 10 Chrome Web Store Terms

• Google Inc. / Google LLC is not a contracting party to this agreement.
• Gato Dynamics (Aljoscha Jürgen Hösselbarth) is solely responsible for the Extension, maintenance, and support.

Section 11 Governing Law & Dispute Resolution

• The laws of the Federal Republic of Germany apply.
• EU Online Dispute Resolution Platform: http://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
